These terms govern your use of the Cereal app and this website. Cereal is operated by Lettermark Partners Limited (“Cereal”, “we”, “us”), a company registered in England and Wales with company number 13709140 and registered office at 29 D’Arblay Street, London, W1F 8EP. By downloading or using Cereal, you agree to these terms. If you do not agree, please do not use the app.

What Cereal does

Cereal is a live, two-person voice translator for iPhone. Translation is produced automatically by machine learning, so it can be inaccurate, incomplete, or delayed. Do not rely on Cereal for critical, medical, legal, financial, safety, or emergency communication, or for any situation where a mistranslation could cause harm.

Eligibility

You must be at least 13 years old to use Cereal, and old enough to enter into a binding contract where you live. If you are under 18, you should only use Cereal with the involvement of a parent or guardian.

Your licence to use Cereal

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app on devices you own or control, for your own personal use. Apple’s standard Licensed Application End User Licence Agreement also applies to your use of the app on iOS.

Passes, subscriptions, and billing

  • Access to translation is provided through paid passes or subscriptions purchased using Apple in-app purchase. Prices are shown in the app before you buy.
  • Payment is charged to your Apple account at confirmation of purchase. Usage is metered by conversation minutes, as described in the app.
  • Subscriptions renew automatically unless you cancel at least 24 hours before the end of the current period. You can manage or cancel a subscription at any time in your App Store account settings.
  • Payments, refunds, and cancellations are handled by Apple under Apple’s terms and policies. We do not process card payments ourselves.

Acceptable use

You agree not to misuse Cereal. In particular, you must not use it unlawfully, resell or commercially exploit it without our permission, reverse engineer or attempt to extract its source, interfere with its operation, or try to circumvent usage limits, metering, or access controls.

Third-party services

Cereal depends on services provided by others, including OpenAI for translation and Apple for distribution and payments. Your use of those services is subject to their terms, and their availability can affect the availability of Cereal. We are not responsible for third-party services.

Availability

Cereal is provided on an “as is” and “as available” basis. We may change, suspend, or discontinue features, and we do not guarantee that the service will be uninterrupted or error-free.

Intellectual property

The Cereal app, the Cereal name and logo, and all related content are owned by us or our licensors and are protected by law. The Cereal logo packages are published publicly for installation convenience only and remain proprietary. These terms do not give you any rights in our intellectual property beyond the licence set out above.

Disclaimers and liability

To the fullest extent permitted by law, we exclude all warranties that are not expressly set out in these terms, including as to the accuracy or reliability of any translation. We are not liable for indirect or consequential loss, or for any loss arising from your reliance on a translation. Nothing in these terms limits liability that cannot be limited by law, such as liability for death or personal injury caused by negligence, or for fraud. Where we are liable, our total liability is limited to the amount you paid for Cereal in the 12 months before the claim arose.

None of these terms affect your statutory rights as a consumer under the law of England and Wales.

Termination

We may suspend or end your access if you break these terms. You can stop using Cereal at any time and cancel any subscription through your App Store account.

Changes to these terms

We may update these terms from time to time. If we make material changes, we will take reasonable steps to let you know. Continuing to use Cereal after changes take effect means you accept the updated terms.

Governing law

These terms are governed by the law of England and Wales, and disputes are subject to the courts of England and Wales. If you are a consumer, you may also have the right to bring proceedings in the courts of the country where you live.
